SIXTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE No. 101/KMK.05/1997

CUSTOMS DECLARATIONS
MINISTER OF FINANCE OF THE REPUBLIC OF INDONESIA,
Considering:
- a. that, m the framework of improving customs services to the public and to enable the mechanism of supervision over the settlement of imported goods granted with exemption of import duty and/or excise and Value Added Tax and Sales Tax on Luxury Goods, it is necessary to amend Decree of the Minister of Finance No. 101/KMK.05/1997 on Customs Declarations;
- b. that, based on the consideration as set forth in paragraph a above, it is necessary to stipulate Decree of the Minister of Finance on Sixth Amendment to Decree of the said minister No. 101/KMK.05/1997 0n Customs Declarations.
In view of :
- 1. Law No. 10/1995 on Customs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612);
- 2. Law No. 11/1995 on Excise (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3613);
- 3. Government Regulation No. 33/1996 on Bonded Hoarding Zone (Statute Book of 1996 No. 50, Supplement to Statute Book No. 3638) as amended by Government Regulation No. 43/1997 (Statute Book of 1997 No. 90, Supplement to Statute Book No. 3717);
- 4. Presidential Decree No. 228/M/2001;
- 5. Decree of the Minister of Finance No. 101/KMK.05/1997 on Customs Declarations as amended several times and latest by Decree of the said minister No. 346/KMK.04/ 2003.
DECIDES :
To stipulate :
DECREE OF THE MINISTER OF FINANCE ON SIXTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE NO. 101/KMK.05/1997 ON CUSTOMS DECLARATIONS.
Article 1
1. Some provisions of the Decree of the Minister of Finance No. 101/KMK.05/1994 on Customs Declarations shall be amended as follows:
Inserting clause m in Article 3 so that Article 3 reads as follows:
"Article 3
Customs Declarations as mentioned in Article 1 consists of:
- a. Vehicle Departure Plan (BC 1.0);
- b. Vehicle Arrival/Departure Document (BC 1.1);
- c. Document on Further Transported Import Goods (BC 1.2);
- d. Document on Transportation of Goods Originating from Customs Area From One Place to Another Through Outside-Customs Area (BC 1.3);
- e. Import Document (BC 2.0);
- f. Document on Import of Certain Goods (BC 2.1);
- g. Document on Import of Vehicle's Passengers or Crews (BC 2.2);
- h. Document on Introduction of Import Goods to Bonded Hoarding Zone (BC 2.3);
- i. Export Document (BC 3.0);
- j. Document on Export of Certain Goods (BC 3.1);
- k. Document on Introduction of Goods Originating from Customs Area to Bonded Zone (BC 4.0);
- l. Document on Settlement of Import Goods Granted with Exemption of Import Duty and/or Excise and Value Added Tax and Sales Tax on Luxury Goods (BC 2.4);
- m. Document on Exit of Goods from Bonded Hoarding Zone (BC 2.5)."
2. Amending Appendix VIII to become as specified in Appendix I to this Decree.
3. Adding Appendix XIII in the Decree of the Minister of Finance No. 101/KMK.05/1997 to become as specified in Appendix II to this Decree.
Article 2
Upon enforceability of this Decree, usage of the Customs Document (BC 2.3) as set forth in:
- 1. Decree of the Minister of Finance No. 399/KMK.01/1996 on Bonded Warehouse;
- 2. Decree of the said minister No. 291/KMK.05/1997 on Bonded Zone as amended several times and latest by Decree of the said minister No. 37/KMK.04/2002;
- 3. Decree of the said minister No. 123/KMK.05/2000 on Entrepot for Exhibition Purpose;
- 4. Decree of the said minister No. 128/KMK.05/2000 on Duty Free Shop;
In the case no amendments have been made and as long as it relates to the exit of goods from the Bonded Hoarding Zone, the Document on Exit of Goods from Bonded Hoarding Zone (BC 2.5) shall be applicable as specified in Appendix II to this Decree.
Article 3
This Decree shall come into effect from May 1, 2004.
For public cognizance, this Decree shall be published in the State Gazette of the Republic of Indonesia.
